    Twins who have been receiving child maintenance from a man who is not their legal father for 15 years have shared their ‘disgust’ over a court decision to remove him from their birth certificates – as a judge heard they lacked gratitude. 

    The man, known only as ‘Mr J’, won a court battle this month to stop a monthly £240 child maintenance payment – after a judge found his name was wrongly put on their birth certificates.

    Mr Justice Cobb made the decision in London‘s Family Court, despite the mother’s protests that the children would be harmed by a ruling that left them with ‘no legal father in the world’.

    He took into account comments from both children, now 16, whose representative in court, Lillian Odze, said they ‘lacked reflectiveness’ and ‘neither of them showed any gratitude’.

    The twins were conceived using IVF fertility treatment in Cyprus during a short-lived relationship between the man and the twins’ mother.

    While the mother’s own eggs were used to create the twin embryos, the sperm came from a donor and there was no genetic link between them and her now ex-husband.

    And while the pair were married at the time of the twins’ birth, they had not been married when the babies were conceived, meaning there is no legal requirement for him to be named as parent.

    Speaking to Mrs Odze, child A said that he felt Mr J ‘should take some responsibility because he was our legal father’.

    He said the court should determine that ‘he is still a legal father’. 

    ‘He should not be able to change that,’ the teen insisted. ‘If you were a legal parent in the first place, you should remain a legal father’. 

    Child A added that if the court found in favour of Mr J, ‘I would feel that he is not helping my Mum at all’. 

    Child B, a girl, said she was not bothered about Mr J not wanting ‘visitation’, but continued: ‘He signed all these papers, why would he suddenly change his mind. 

    ‘He should continue with the money because it’s helpful.’

    She also referenced the fact that Mr J had adopted the step-daughter of his current partner, asking: ‘Why would you adopt a child if you did not want us. [It] made me wonder why he wanted her and not us.’

    And she said she would be ‘disgusted’ and ‘disappointed’ if Mr J was declared to not be her legal father.

    Representative Mrs Odze told the judge that neither twin had a positive view of Mr J, and that they appeared ‘detached’ from the fact that he had been paying towards their upkeep. 

    ‘They lacked reflectiveness when I noted that neither of them expressed any gratitude towards [Mr J] for this commitment,’ she noted.

    ‘As their legal father, it was his duty to do so and indeed to continue to do so for merely another two years until their majority’.

    The court heard that the maintenance payments went beyond funding the basic necessities and were spent on school trips and clubs for the children.

    The court was also told that A and B are ‘secure in their family unit’, which includes their mother, her fiancé and their younger half-sister.

    Mr J has had ‘no contact with the children of any kind since the parties separated more than fifteen years ago – no visits, no cards, no letters, no photographs’, it was said.

    Last month, he applied to be legally removed as the twins’ father in a bid to stop paying child maintenance as he has now been forced to retire through illness, and says he can no longer afford to pay.

    The pair had been happily married for just 18 months before separating in October 2009, before divorce proceedings followed in 2011. 

    Mr Justice Cobb in allowing Mr J’s application said that, under the law at the time the twins were conceived, he was not legally their father and should not have been on their birth certificate in the first place.

    The Human Fertilisation and Embryology Act 1990, determined that a man who engaged in IVF treatment not involving his own sperm was only legally deemed to be the parent of any child that resulted if the IVF took place at a registered UK clinic.

    Because the procedure took place abroad and he had no genetic link with the babies, Mr J had never had been their legal father, the judge said.

    ‘He has had no contact with the children of any kind since the parties separated more than 15 years ago – no visits, no cards, no letters, no photographs,’ the judge noted.

    ‘But throughout the whole period, it is agreed that he has maintained them financially…over the last sixteen years.

    ‘Mr J states that he has now retired from working on grounds of ill-health, and now cannot continue to pay.

    ‘Mr J contends that, as he is not the biological father of A and B, his legal status should reflect this.

    ‘He refers to the lack of relationship with A and B, and observes that his only link with them over the years has been a financial one through his payment of maintenance.

    ‘Importantly he told me that he had ‘written off’ the money which he had paid to the mother for the children over the last 15 years; he has no wish to recover it. He simply wishes the liability to end at this point.

    ‘The mother opposes the application, asserting that Mr J had been fully involved in the assisted reproduction process and they had embarked on this course on the basis that he would become the father to A and B.

    ‘She was concerned about the negative impact on B, in particular, of any declaration that Mr J is not in law her parent, adding that she could not understand ‘how declaring that [the children] have no legal father in the world is ever in the children’s best interests, especially when [B] clearly feels very rejected’.

    ‘Mr J and the mother were not married at the time of A and B’s conception.

    ‘The conception took place otherwise than in a clinic licensed in the UK; and…the conception was achieved using sperm which was not that of Mr J.

    ‘The Human Fertilisation and Embryology Act 1990 does not treat Mr J as A and B’s father.

    ‘The fact that Mr J was erroneously registered as the children’s father on their birth certificates does not itself confer legal parentage on him,’ said the judge.

    He went on to make the declaration of non-parentage, despite the mother’s protests, saying: ‘Clarification as to A and B’s legal parentage should promote their true identity… this will, in my judgment, be to their benefit throughout childhood and adulthood.

    ‘Specifically, the mother will no longer be required to obtain formal consents from Mr J in relation to formal processes such as passport renewal.’

    The judge added that both, ‘are obviously bright and engaging young people. They have completed their GCSEs with good results.

    ‘They are now in secondary education studying for A-levels. They are both aware that they were conceived through donor fertility treatment.’

    He concluded that expert reports suggested that the impact of losing Mr J as their legal father on the children ‘is likely to be… minimal.’

    Mary Kielty died peacefully at her home in Dundrum, Co Down last Saturday at the age of 84. Her funeral took place on Monday.

    On Friday night, after taking viewers around the world for the best of Irish dancing and bringing Riverdance into the studio, Patrick Kielty opened the show by saying: “When you’re called Patrick, St Patrick’s Day is always special. And the person I have to thank for that and so much more is my mum.

    “Sadly, we lost her last week, and I just want to say a huge thank you to everyone who took care of her and took care of our family this week.”

    “My mum watched this show religiously,” he continued. “And she loved it so much she still kept watching even after I got the gig.

    “In over 50 years, Mary never missed a Late Late Show, and there was no way she’d want me to miss this one for her tonight.

    “And so, I couldn’t be prouder to stand here and say, ‘This one’s for you, Mary’. Welcome to The Late Late Show.”

    On the night, the “best of Irish” show featured members of the Italia 90 squad, the Dancing with the Stars finalists, singer-songwriter Cian Ducrot, and B*Witched as guests.

    Worried parents have warned council and religious leaders they have a ‘fight on their hands’ over plans to close four schools to create a Catholic super-school in Flint.

    Governors of the 153-year-old St David’s Catholic Primary School in Mold held a public meeting on Thursday evening to raise concerns about the proposals.

    More than 50 parents, grandparents and parishioners attended to share their views with Flintshire Council Cabinet member and Mold East Councillor Chris Bithell.

    They want to stop the closure of St David’s – which has around 80 pupils – as part of a scheme that will also see the closure of St Anthony’s Catholic Primary School in Saltney, St Mary’s Catholic Primary School in Flint and St Richard Gwyn Catholic High School in Flint.

    If approved, the proposals will replace those four schools with a single Catholic super-school in Flint for children aged 3-18 – known as an All Through School.

    On Tuesday, March 18  Flintshire Council’s Cabinet will decide whether to begin consulting on the plans, with a target decision date of December.

    “Who in the Diocese has made this decision on our behalf,” one angry parent asked during the meeting. “Was it Bishop Peter (Brignall)?

    “We make a financial contribution to the school through the Diocese yet it has not had any discussion with us before moving forward with these plans.”

    Parents criticised the impact the proposals would have on children’s quality of life – having to get up earlier to get to Flint and getting home too late for other extra-curricular activities.

    Among their issues were the environmental impact of driving pupils a greater distance to school and the risks of potentially having to place children as young as five on school buses to Flint.

    They also argued St David’s is financially viable despite its small size, having not gone into a budget deficit.

    And they suggested future housing developments in Gwernaffield and potentially on the site of Shire Hall in Mold would counter declining pupil numbers.

    But their primary concerns were around safeguarding, quality of education and Special Educational Needs (SEN) provision.

    “This school delivers a fantastic education for our children,” said one angry parent. “It is a supportive community and one in which children thrive. It offers high quality teaching and a sense of community. That simply can’t be replicated at a super-school.”

    The chair of the meeting, Sarah Cunningham, asked Cllr Bithell at one stage: “Do you have grandchildren? Would you let your grandchildren, aged five, get on a bus on their own from Mold to Flint?”

    Cllr Bithell agreed he would not.

    Another parent highlighted that SEN provision at St David’s was outstanding and warned the same level of support would not be possible at a larger school.

    “When my child goes to school at St David’s he is ‘normal’,” said the mum. “He needs additional support but the teachers understand him, the other pupils understand him and he doesn’t feel left out. He can participate in school and be an active part of the community.

    “In a large school he would never get that attention or support.”

    One grandparent summed up the feelings of everyone present when he told Cllr Bithell: “You’ve got a fight on your hands.

    “We do not believe this is the right decision for our children or the school.”

    Cllr Bithell thanked those in attendance for sharing their views as he was presented with a petition in support of keeping the school open.

    “I appreciate you inviting me here to listen to your views,” he said. “As the ward member for this area I understand how important the school is and what a vital part it is of the fabric of the community.

    “You have all raised a number of very powerful points for me to consider.”

    When asked if he would support parents in their opposition, Cllr Bithell reserved judgement.

    “This has not yet been opened up for consultation by Cabinet,” he said. “I can’t make a decision until I have seen all the details and proposals.”

    Following the meeting the Diocese of Wrexham was approached for a response.

    “We are awaiting a Cabinet decision to move to a statutory consultation process,” it said.

    It added that St David’s was currently was only 49% full. Projections estimate the surplus of places to increase to almost 65% due to falling pupil numbers by 2029/30.

    The Diocese also disputed the financial viability of the school.

    “St David’s currently has a £148,000 backlog of repairs and maintenance,” it said.

    “The initial plans were drawn up after a full process of discussions with the chairs of governors and headteachers at the six Catholic schools in Flintshire in liaison with the Diocese and local authority. There was no disagreement from any of these parties regarding the proposed plans.”

    The Diocese did not deny that a land swap was part of the arrangement, but said final details were yet to be agreed.

    “To ensure that precisely the same information was given at each of the 12 meetings on Tuesday, February 11 , an information film was sent to schools to be introduced by the headteacher or chair of governors,” it said.

    “They were asked to collate any questions and comments from each of the meetings and send them to the Diocese for a response. These questions have all been responded to on the FAQ page of the Diocesan education website.”

    A US hunting influencer who caused outrage in Australia after grabbing a baby wombat from its mother says she is sorry for the incident but was only trying to ensure its safety by removing it from a road.

    Sam Jones left the country on Friday morning after the home affairs minister, Tony Burke, said immigration authorities were checking if she had breached the conditions of her visa.

    Early on Saturday morning, she posted a 900-word statement on her Instagram account, claiming she had been subject to thousands of death threats, and questioning the outrage in a country whose government “allows and permits the slaughter of wombats”.

    It is an offence to harm a wombat in Australia unless a permit is obtained from the government.

    She also railed against the killing of kangaroos and brumbies.

    Jones said she was “extremely concerned” when she found the wombats on the road, and stopped to ensure they were not hit by a car.

    When she walked up to the baby and it did not move, she thought it may have been sick or injured, so decided to pick up the wombat to check.

    “I ran, not to rip the joey away from its mother, but from fear she might attack me. The snap judgement I made in these moments was never from a place of harm or stealing a joey.

    “While I was unbelievably excited to see such an amazing animal, I looked it over quickly and immediately returned it to its mother. I ensured that the mother and joey did reunite, went off together, and that they got off the road.

    “I have done a great deal of reflection on this situation and have realized that I did not handle this situation as best as I should have … I have learned from this situation, and am truly sorry for the distress I have caused.”

    She insisted that the incident had not simply been confected for content.

    “I want to make it absolutely clear that this was never about social media or getting likes.

    “This was not staged, nor was it done for entertainment. In my excitement and concern, I acted too quickly and then failed to provide necessary context to viewers online.”

    Burke, who is also the immigration minister, said on Thursday that he couldn’t “wait to see the back of this individual” and authorities were “working through the conditions” on Jones’s visa to determine “whether immigration law has been breached”.

    The Australian prime minister, Anthony Albanese, said Jones’s actions were “an outrage” and suggested she should try to “take a baby crocodile from its mother and see how you go there”.

    RSCPA Australia said the footage showed a “blatant disregard” for native wildlife and the distress to the joey and the mother caused by the “callous act” was clear.

    Mumbai: Parents of a 3.6-year-old girl from Malad West who was allegedly sexually assaulted within her school premises on February 12 have approached the high court, alleging inaction by the Bangur Nagar police and seeking a thorough investigation into the matter by a competent authority.

    According to the petition, the girl complained of acute discomfort and inflammation in her abdomen after returning from school at around 6.30pm on February 12. She told her mother that a (male) “monster” at school had “rubbed” (molested) her, following which the parents promptly contacted the school authorities for redressal. They also took the girl to a private hospital, where a junior doctor examined her and asked her to return the next day for consultation with a senior doctor.

    “The next day, a senior gynaecologist corroborated the initial concerns raised by us and confirmed that the matter needed to be investigated from a sexual assault point of view and a medico-legal case was warranted,” the petition said.

    Subsequently, the girl’s parents filed a complaint at the Bangur Nagar police station, seeking registration of a First Information Report (FIR). They also approached the state-run Cooper Hospital, where an examination confirmed the possibility of sexual assault. Yet, the police hesitated to register an FIR and showed little inclination to conduct a thorough and impartial investigation even though the girl had named the culprits in her statement recorded before a magistrate, the petition said.

    The petition further said that although an FIR was registered under the POCSO Act, no arrests were made even after 30 days since the incident.

    “The police failed to secure video footage promptly and initially withheld information about the sickbay room and its attached washroom, raising serious concerns about their potential involvement in concealing crucial evidence. The school too refused to disclose all CCTV footage, delaying the review process, and intentionally concealed the existence of a second washroom,” said the petition. The police also failed to conduct a thorough investigation of not just the girl’s clothes but also the school premises, the petition noted.

    Anil Thackrey, senior police inspector from Bangur Nagar police station, denied the allegations of inaction, saying they had registered an FIR against an unknown person and recovered CCTV footage from the day of incident as well as before and after that.

    “No suspects are seen in the CCTV footage, which we have handed over to the parents as per their request. But they also want CCTV footage of the school’s first floor and the sick room, which the girl did not visit,” said Thackrey. “We are conducting the investigation and trying to find the suspect,” he said.
