    The Central District Court accepted on Monday an appeal of the birth mother of a baby who was implanted in the wrong mother in the September 2022 embryo swap incident, and ruled that the child, Sophia, would stay with the birth mother and her partner.

    The incident originally came to light after tests showed a pregnant woman who underwent IVF at Assuta Medical Center in Rishon Lezion was carrying a baby that was not genetically related to her or her husband – revealing that the wrong embryo had been implanted during her treatments.

    The appeal, accepted Monday, was submitted in November following a lower court ruling that Sophia should be transferred to her genetic parents.

    The court also ruled that the child’s best interest requires recognizing the birth mother’s partner as her legal father to prevent a situation where she has two sets of parents.

    Given Sophia’s young age and her challenging medical and developmental condition, maintaining a secure attachment with her current caregivers is of critical importance, the judges stressed.

    They further explained that separating her from them could cause irreversible harm, based on scientific findings in developmental psychology.  

    It is also critical to ensure that Sophia maintains a relationship with her genetic parents and learns about her life story in a way that is appropriate for her age and abilities, the court said.

    Relationship with genetic parents

    Welfare authorities will establish a structured framework to allow her to maintain a continuous relationship with her genetic parents while safeguarding her well-being and mental health.  

    The court’s decision sets a precedent in cases involving biological versus adoptive parenting, raising fundamental questions about parental rights in cases of medical errors in fertility treatments. The ruling acknowledges that parenthood is not determined solely by genetic ties but also by the emotional bond, commitment, and dedication of the adoptive parents in raising the child.

    The lawyer representing Sophia’s birth parents welcomed the decision and told Walla that it “creates grace and order in the rights of parents and children in the age of IVF.

    “As a woman, a mother, and a lawyer in Israel, I welcome this ruling, which was issued in alignment with International Women’s Day. In my view, this decision upholds women’s rights—particularly those of mothers who conceived and gave birth through IVF—ensuring their rights are equal to those of all women in the country.”

    Sophia’s genetic parents also responded to the verdict, calling it unbearable, and saying that they may appeal the decision.

    “We are shocked and heartbroken by the decision to overturn the ruling of the Family Court. The painful message conveyed by this decision is that grave mistakes and injustices are not only left uncorrected but are legitimized and perpetuated under the state’s authority,” they said.

    “Our only concern is Sophia’s well-being, her future, her identity, and her life story,” they added, saying that “she has her whole life ahead of her, and we believe that her long-term well-being lies in growing up with her biological family, to whom she bears a resemblance and to whom she was meant to be born. We will study the decision and consider our next steps to rectify this injustice.”

    A Scots nursery faces legal action after a one-year-old baby broke her leg falling off a nappy changing table when left unattended.

    Skye Tucker was just 90 minutes into her first day at Little Clouds Nursery in Aberdeen on January 7 when she suffered the injury. Her parents fear her trauma worsened as she did not receive medical care until later that evening.

    Nursery bosses admitted the incident was due to a “complete lapse in judgment” after a staff member left her unattended while looking for nappy cream. The Care Inspectorate investigated and upheld five complaints, citing numerous failings in care and communication.

    Parents Kyle, 39, and Sheena Tucker, 38, are taking legal action for negligence.

    They said in a statement: “We were shocked to learn the extent of her injuries and how avoidable this was. Not leaving a baby unattended on a high changing table is one of the most basic rules in a nursery.

    “The fact she was left without real medical attention for most of the day continues to upset us when we think about the pain she endured.

    “Skye seems to be recovering well, which is the main thing.

    “In fairness to the nursery, we appreciated their quick apology and transparency. The Care Inspectorate findings were welcome, but it’s important for parents to know the full facts to make informed decisions about childcare.

    “Our focus now is Skye’s full recovery and ensuring other children are protected from the same errors.”

    Skye was attending her first full day after previous settling-in sessions at Little Clouds, where her twin brother Aaron was also enrolled.

    At 9.10am her parents were notified via the nursery’s social media service. A staff member wrote: “While changing her nappy, I turned to get cream from the cupboard. As I did, Skye rolled off the mat and fell. She was sad but has had cuddles and is fine.”

    The message mentioned an ice pack was applied, but her parents weren’t informed of the seriousness. When Skye showed discomfort at home, they took her to A&E, where an X-ray at Royal Aberdeen Children’s Hospital confirmed a proximal tibial fracture in her right leg and a facial bruise.

    Later that evening, a senior nursery staff member apologised, explaining the incident was due to a health and safety breach regarding “constant supervision.” Management clarified that the changing station was high-risk and the staff member responsible faced internal disciplinary action.

    A Care Inspectorate review found five failings, including an incomplete update to the parents. Skye and Aaron now attend a different daycare provider.

    A spokesperson for Digby Brown solicitors said: “An incident like this is a parent’s worst nightmare. Childcare is not just about trust but processes to ensure safety. It’s extremely fortunate this wasn’t more serious.

    “We will support the Tucker family in civil action to ensure Skye recovers fully and care services improve.”

    Little Clouds Nursery stated: “We sincerely apologise to the child and family. We didn’t meet the standards they deserved.

    “An internal investigation identified policy changes and improvements needed to ensure child safety. Since then, we have worked with the Care Inspectorate and kept families informed.

    “The staff member involved no longer works here and has been reported to relevant bodies. Other involved staff faced disciplinary action.

    “This is our first incident in seven years, though one is too many. Our priority is making swift and robust changes to ensure this never happens again.

    “We continue working with the Care Inspectorate and look forward to a future re-inspection.”

    The Care Inspectorate has been contacted for comment.

    Clifford spoke about women at work in ‘sexualised’ way – prosecution

    The prosecution said after time in the army, Clifford later worked at a catering firm, where he allegedly made “inappropriately sexualised comments” to people.

    He would also talk about whether he could have sex with female colleagues – including “I could ride you”, Alison Morgan KC said.

    His remarks were made while he was still going out with Louise Hunt, and he allegedly had relationships with two other women while in a relationship with Louise, the court heard. The prosecution says Clifford would “discuss bodily features” of women in a “lustful way”.

    Morgan said that a supervisor noted “immaturity” at work and described how he referred to his brother Bradley Clifford, who is serving a life sentence for murder, as a “geezer”.

    Prosecutor Alison Morgan KC said Clifford, who served in the military from 2019 for about three years, had “no care nor concern beyond himself” during his time in the army. “He appeared unable to accept the authority of others,” Morgan said.

    Clifford had been a trooper in The Queen’s Dragoon Guards, but left the army after two years in 2022.

    The court heard the defendant was involved in an “alcohol-fuelled” incident in 2021 while in the army in which resulted in “soldiers drinking and then an altercation”.

    Ms Morgan said Clifford was also involved in a further altercation with civilians and had to be “forcibly ejected from a pub”.

    The prosecutor added: “His commanding officer concluded that he… was wholly unsuited to military employment and has no care nor concern beyond himself.”

    The prosecution is outlining the facts of the case. Prosecutor Alison Morgan KC says Kyle Clifford committed acts of “extreme violence” against the Hunt family.

    “He correctly assumed friends and family members had advised Louise to end the relationship,” Morgan told the court.

    “He set about planning a catastrophic attack on the Hunt family.”

    “Those events came to be because of their relationship ending as it did towards the later stages in June of 2024,” Morgan continued.

    “Louise Hunt instigated the end of that relationship. She was supported in doing so by her friends and family.

    “In the days that followed, the defendant was prompted to try to rekindle that relationship.

    “When Louise Hunt held firm, that rejection angered the defendant. He was angry, not just at Louise Hunt, but also at the Hunt family generally.”

    The judge said today will be a “challenging” day and reminds those in attendance to remain as calm as possible during the hearing. “We really must preserve quiet and decorum in this room,” he said.

    Timeline and events leading to the triple murder

    Kyle Clifford previously pleaded guilty to murdering Louise, Hannah and Carol Hunt, one count of false imprisonment and two charges of possession of an offensive weapon.

    He was last week found guilty of raping Louise Hunt on the day of the triple murder, having previously denied committing it.

    Here are the key dates and times before and after the murders:

    Louise Hunt ends her relationship with Kyle Clifford, telling him in a message: “I feel like it’s been broken and I can’t ignore how I’ve been feeling or made to feel in our relationship over the course of the year.”

    2.32pm: Clifford knocks on the door of the Hunt family home with a black rucksack containing a knife and tells Carol Hunt he wants to return items of property.

    Clifford is finally fit to be interviewed by police where he says “sorry” and “what I have done is atrocious”.

    John Hunt, a BBC racing commentator, and his surviving daughter Amy have arrived at the court and have been allowed to enter Court 1. They have previously said their devastation over the murders “cannot be put into words”. The hearing is expected to start in about five minutes.

    Former soldier Kyle Clifford is facing life behind bars as he is due to be sentenced today for the crossbow murders of his ex-partner and her sister, and for fatally stabbing their mother.

    Why Broadcom Soared Even as “Baby Broadcom” Plunged Last Week

    Artificial intelligence stocks have taken a beating over the past month. While AI-fueled enthusiasm caused several stocks to boom in 2024, investors now appear to be experiencing angst over valuations in the face of potential tariffs, trade restrictions to China, or a digestion period in AI spend.

    Two 2024 winners were Broadcom (NASDAQ: AVGO) and Marvell (NASDAQ: MRVL). Their portfolios are somewhat similar, so much so that Marvell is sometimes called “baby Broadcom.”

    However, when each stock reported last week, Marvell plunged, while Broadcom soared. It was an interesting dichotomy and may have reflected a few changing dynamics in the AI races.

    While there are differences between the two, both Marvell’s and Broadcom’s portfolios are weighed toward infrastructure chips for networking and communications, along with custom ASIC IP that cloud hyperscalers use in their custom AI accelerators, called XPUs.

    All eyes in recent years have been on custom ASICs, which have seen hypergrowth as the AI buildout has accelerated. Marvell CEO Matt Murphy noted that two years ago, Marvell projected about $200 million in ASIC revenue in calendar 2023 and $400 million in 2024. But Marvell wound up exceeding $1.5 billion in 2024, with management projecting more than $2.5 billion in 2025!

    However, the topic of ASICs is also where things got dicey for Marvell during its conference call.

    You see, Marvell’s ASIC revenue is highly concentrated in a single customer: Amazon (NASDAQ: AMZN). Marvell also also works with Alphabet on Alphabet’s new Arm-based CPU, but not its AI accelerator, as we’ll see.

    Although Murphy noted that it has great visibility into ASIC revenue this year and next , one analyst asked about rumors of potential competition for the business of its all-important customer. Murphy answered:

    [T]o be crystal clear, we do expect revenue from these custom XPUs with this customer, not only to grow in fiscal ’26, which is the year we’re in, but to grow in fiscal ’27 and beyond. And I just want to also note that I’m not including revenue here that would be from other products, access networking connectivity that would be incremental to custom. And certainly, we’ve got a great setup, I think, overall with this account relative to the opportunity set, but it’s really on both. And then with respect to the question that our customer may be working with someone other than Marvell on a next-generation XPU, it’s just something we can’t comment on.

    That last line was likely the one that spooked investors, especially in a nervous market in which investors seem to be looking for reasons to sell. A lack of a definitive “no,” to the rumors about Amazon switching all or part of its custom chipmaking off Marvell’s IP may have worried investors over the sustainability of Marvell’s ASIC growth.

    On the other hand, not only did Broadcom report blowout AI numbers of its own, but CEO Hock Tan also noted Broadcom had engaged with two additional potential ASIC customers.

    Currently, Broadcom has three major ASIC customers. Its biggest is Alphabet for its tensor processing units (TPUs), along with what many believe to be Meta Platforms and China’s Bytedance, the owner to Tik Tok. On its previous earnings call in December, Broadcom noted that it had engaged an additional two customers for custom ASICs.

    But on last week’s earnings call, Broadcom said it has now engaged with an additional two potential custom ASIC customers on top of the previous two. While we don’t know who those two new customers of interest might be, it could suggest a potential engagement with Amazon. Of course that’s highly speculative at this point.

    Before Marvell investors freak out, some industry sources believe the original two new customers announced in December were Apple and OpenAI, while the two new customers alluded to last week may be Oracle and Elon Musk’s xAI. But again, those four potential customers have not been confirmed by Broadcom.

    In any case, the prospect of having Broadcom add even more customers to its already-larger roster of custom ASIC customers bolstered its stock. Meanwhile, doubts over Marvell hanging on to its single biggest customer longer-term likely dented sentiment.

    In addition to the differing narratives over custom ASIC customers, valuation likely played a role in both Broadcom’s and Marvell’s recent fortunes. While Broadcom has more custom ASIC customers and a more diversified business with its high-margin software segment, it still traded at a lower valuation than Marvell heading into last week.

    Both companies’ valuations look extremely high on a GAAP basis, since each has a lot of amortization of intangible assets on its income statements, because of both companies’ history of acquisitions. However, unlike the depreciation of property, plant, and equipment, intangibles amortization isn’t really an ongoing cost that has to be replaced by capital expenditures, as depreciation is. So in these cases, looking at both companies valuations on a non-GAAP basis is probably appropriate.

    Marvell made a little over $1.3 billion, or $1.57 per share on a non-GAAP basis in its fiscal year ended in January, which makes its current P/E ratio on adjusted earnings about 46.8 times. Prior to its report earlier this week, the stock traded at 57.3 times. And at its January highs, Marvell traded at 81.2 times trailing earnings.

    Meanwhile, Broadcom currently trades around 36.3 times trailing-12-month adjusted EPS. Heading into earnings, that figure for Broadcom was just 33.5.

    Marvell may have been valued higher since it’s a smaller company, and most investors seem to think that the smaller a company is, the larger its growth prospects. However, Broadcom has been able to defy those limitations of large numbers. After all, Broadcom’s 25% growth last quarter was nearly as fast as Marvell’s 27% growth, despite Broadcom being about nine times as large.

    When comparing two companies, two big elements to consider are customer concentration, as well as valuation.     A viral video falsely claimed Indian and Pakistani cricket teams mourned Virat Kohli’s father’s death. PTI Fact Check revealed it was from the ICC T20 World Cup 2021 supporting the ‘Black Lives Matter’ movement

    A video recently circulated on social media, with users claiming it showed Indian and Pakistani cricket team players mourning the death of Virat Kohli’s father, Prem Nath Kohli, as soon as the news broke to them during the recent Champions Trophy match. The video began with India opener Rohit Sharma having a brief conversation with Pakistan cricket team captain Babar Azam, followed by a scene where Indian players kneeled on the ground. In contrast, Pakistani players stand with their hands on their chests.

    However, the PTI Fact Check Desk investigated and found this claim to be false. The video was actually from the ICC Men’s T20 World Cup 2021, where both teams (India vs. Pakistan) showed support for the ‘Black Lives Matter’ movement before the match commenced. In the footage, the Indian team kneeled to express solidarity, while the Pakistani team placed their hands on their chests as part of the gesture. An old and unrelated video was misleadingly shared on social media with a false claim.

    Claim

    A Facebook user going by the name ‘Amrish M A Raj’ shared a video on March 4, claiming it showed Indian and Pakistani cricket team players observing a minute of silence during a live match after hearing about the passing of Virat Kohli’s father, ‘Prem Nath Kohli.’ The video showed Indian team players kneeling on the ground, while the Pakistani team players stood with their hands on their chests. Since being posted, the video has received 15 million views.

    Investigation

    The Desk ran the viral video through the InVid tool search and extracted multiple keyframes. Upon running one of the keyframes through Google Lens, the Desk found various users shared the same video with similar claims. Two such posts can be found here and here, and their archived versions can be viewed here and here, respectively.

    The search results also led the Desk to a report published by India Times on October 25, 2021. The report includes images of Indian and Pakistani cricketers (as also seen in the keyframes the Desk used for investigation) extending support to the Black Lives Matter movement during the ICC Men’s T20 World Cup 2021. It showed Indian cricketers kneeling on the ground. At the same time, Pakistani players kept their hands near their chests to support the movement against racism, which was started in the United States after the death of 46-year-old African American George Floyd in the year 2020.

    Below is a combination image highlighting that the content seen in the viral video matched that of the images used in the India Times report.

    In the next part of the investigation, the Desk conducted a customized keyword search on Google and came across a report by the Times of India. The report, published on September 19, 2024, elaborated on the circumstances surrounding the death of Virat Kohli’s father, Prem Nath Kohli, in 2006. The report revealed that Virat Kohli’s father died in December 2006, when Virat was just 18 years old.

    “In a 2006 Ranji Trophy match, batting maestro Virat Kohli demonstrated remarkable commitment by playing for Delhi against Karnataka despite losing his father. At 18 years old, he returned to the field the next day and scored an essential 90 runs, helping his team recover from a tough spot,” the report added.

    The HSE has issued a warning to parents who allow their baby to sleep in their bed, reminding them that “the safest place for your baby to sleep is in a cot in the same room as you.”

    The HSE website issues advice on co-sleeping, warning parents to avoid the practice due to a number of dangers.

    The advice states: “A separate cot in your room is the safest place for your baby to sleep. Bed sharing or co-sleeping in the same bed can be dangerous. It can increase your baby’s risk of suffocation or cot death.

    Suffocation can happen when your baby: slips under the bed covers, rolls under an adult, gets trapped between the bed and the wall, falls out of the bed.”

    “Your baby should not share a bed with your other children,” it continues.

    “The advice further states: “Do not share a bed with your baby, if you or your partner: are smokers, have taken alcohol, drugs (legal or illegal) or medicines that can make you drowsy, are over tired, your baby is less than 3 months old, was premature (born before 37 weeks), had a low birth weight – less than 2.5kg (kilograms) or 5.5lbs (pounds).

    “The risk of cot death is higher for babies who sleep in a separate room. Keep your baby’s cot in the same room as you for at least the first 6 months.”

    In terms of cot safety, the HSE advises that you “make sure the cot is in good condition and correctly assembled.

    “The mattress should be clean, firm and flat with no rips. It should fit the cot. An uneven mattress could allow your baby to roll onto their side and tummy.

    “There is a risk your baby could get trapped in a gap between the mattress and the edge of the cot if the mattress does not fit properly. This could lead to suffocation.

    “Do not use sleep positioners and other similar products. They do not prevent cot death or flathead syndrome (plagiocephaly), and are a suffocation risk.

    “Pillows and cushions should not be in the cot as they could suffocate your baby.

    “Do not use them to elevate your baby’s head during sleep. This does not reduce reflux and is not recommended.

    “Keep the cot clear of all objects Do not have any soft objects and anything loose or fluffy in your baby’s cot. This includes: cot bumpers, blankets, duvets, toys, teddies, wedges and bedding rolls. These objects could suffocate or smother your baby,” the website states.
